Subject: Sixth Central Pay Commission’s recommendations- amendment of Service Rules -regarding
Kind attention is drawn to the DOPT Office Memorandum referenced above. In the Memorandum, for promotion from JAG to SAG level, the eligibility requirement for all organized Group ‘A’ services has been stipulated as follows:
“Officers in the JAG with 8 years' regular service in the grade including NFSG OR Officers with 17 years' regular service in Group 'A' posts in the service out of which at least 4 years' regular service should be in the JAG (including service rendered in the NFSG of the JAG.)"
In this regard, it is bring to your kind notice that in Group “A” Engineering Services the functional JAG is at Grade Pay Rs 8700 and it requires 3 years of regular service to become eligible for promotion to SAG (GP: Rs 10000) (Please refer to the Department of Personnel and Training Office Memorandum (O.M.) No. 22/1/2000-CRD dated June 6, 2000 as modified through DoPT circular no. 22/1/2000-CRD dt 20/12/2000), whereas in other Group “A” services functional JAG is at Grade Pay Rs 7600 and it requires 8 years of regular service to become eligible for promotion to SAG (GP: Rs 10000). Because of the referenced stipulation, eligibility for promotion from JAG to SAG has unduly and unjustifiably increased from 3years to 8 years. In the light of this, following modification in the referred Memorandum is proposed:
In continuation with above. “Officers in the JAG with 3 years' regular service in the grade OR Officers in the JAG with 16 years' regular service in Group 'A' posts in the service out of which at least 1 years of regular service should be in the JAG."
[Note: We propose 16 years of regular combined service because the eligibility for organized Group ‘A’ Engineering Services from JTS to STS is 4yrs, STS to JAG (functional) 9yrs and JAG to SAG is 3 yrs. This adds upto 16 yrs.]
The eligibility criteria for promotion from SAG to HAG as per the circular, is acceptable to Engg Services without any modification.
Further it is to submit that for the organized Group ‘A’ Engineering Services there should be combined service criteria for the promotion from STS to JAG. The eligibility criteria for other organized Group ‘A’ services for Selection Grade (Non-functional) in the Junior Administrative Grade (NFSG) is “Officer in the JAG who has entered the 14th year of service on the 1st January of the year calculated from the year following the year of examination on the basis of which he or she was recruited”. This effectively means that the officers of other organized Group ‘A’ services attains the PB4 band in the 14th year of his service irrespective of any delay in joining the service or promotion at any prior stage. However, for organized Group ‘A’ Engineering Services there is no such criteria and any delay in joining or promotion at a prior stage gets carried forward. Even in the best possible scenario, an Engineering Services officer can reach PB4 band after 15 ½ years of service. Hence, Engineering Services officer are at a serious disadvantage in reaching the PB4 band vis-à-vis other Group A services.
It is submitted that till there is combined service criteria at 8700 grade pay (PB4 band) in Organized Group ‘A’ Engineering Services, the 6th CPC recommendation for bringing uniformity in eligibility criteria across various organized Group ‘A’ Services for promotions, cannot be attained. To correct this anomaly, we propose that the criteria for promotion from STS to JAG should be as follows:
STS to JAG: Officers who have completed 13 years of Group 'A' service in the service, calculated from the 1st Jan. of the year following the year of examination on the basis of which he or she was recruited , out of which at least 4 years of regular service should be in the STS Grade including the service rendered in non-functional Grade Pay of 7600.
We request you to kindly consider the above and issue an office memorandum accordingly.

Very usefull input has come from Sh N K Sharma, Thanx Sir. The EE ( NFSG) gd pay 7600 is the JAG Non Functional and gde pay 8700 is the JAG functional for engineers. As far as engineers are concerned the residency period at JAG shall start with gde pay 7600. The Director in Centre is with grade pay 8700. Thus to reach SAG grade the residency period of gde pay 7600 JAG shall be enough.The extract of V th pay commission as sent by SH N K Sharma is enclosed. Pl find rhe reco of 5th CPC as desired Pay scale for Superintending Engineers 50.45 We would, however, like to make an exception only in case of Superintending Engineers. It is a fact that the Second CPC had already established a parity between Superintending Engineers and Conservators of Forests by granting them both the scale of Rs 1300 – 1800. This parity was cemented further by the Third CPC which observed that “For the post of Conservator of Forests we recommend the scale which we have recommended for the Superintending Engineer grade of the Central Class I Engineering Service viz Rs 1800 – 2000.” For the Selection Grade of Conservator of Forest, the same commission stated that “a selection grade of Rs 2000 – 2250 should be introduced for the Conservator of Forests, on the same principle as recommended for the Selection grade in the Central Class I Engineering Service.” Between the Third and Fourth CPCs, there was an upgradation of the first grade for CFs to Rs 1800 – 2000. Subsequently, the Fourth CPC merged the scales of Rs 1800 – 2000 and the Selection Grade of Rs 2000 – 2250 and gave CFs the single functional scale of Rs 4500 – 5700. The same treatment in spirit was unfortunately not accorded to the SEs who were given a JAG of Rs 3700 – 5000 and NFSG of Rs 4500 – 5700. Taking into account the significant role of engineering services in the nation building process and the fact that the promotional prospects in the engineering cadre are rather bleak, We recommend that NFSG of RS 4500 – 5700 should be converted into a single functional scale for Superintending Engineers and the scale of Rs 3700 – 5000 should instead be the non-functional JAG for Exe. Engineers. However, in order to avoid too fast a rate of promotion in certain cadres to this grade, it is further recommended that promotions to the scale of Rs 4500 – 5700 would be permitted only on completion of 13 years of service in Group ‘A’. Although the above recommendation is being made in the context of CWPD engineers, it is clarified that this dispensation will be available to all Engineering Cadres in the Government.

It is thought to sort out the logjam on preparation of pay parity DPC list , following is the extract which can be sent to concerned officers officially or by indl officers to meet the iterpretation of other officers at E-in-C;s Br. The main issue is to delink pay parity with the functional eligiblity as mentioned in our RRS . My considerate opinion is that non functional and functional promotions can not be intermixed. The amdt to RR are required to show NF upgradation linked with the total length of the service. Kndly read the following as proposed to be sent to DPC .
The amdt to RR is in progress based on DOPT letter no AB.14017/61/2008-Estt(RR)Pt Dated 15 Dec 2009. Since Amdt to RR is a time consuming process the non functional up gradation( Pay Parity) based on the DOPT letter dt 24 April 2009 as ref in MoD note ref in Para 1 shall be granted to all eligible officers. 4. Eligibility Condition for non Functional Up gradation as per various DOPT letters ref is appended below . a) As per DOPT letter no. AB 14017/64/2008-Estt(RR) Dt 21May 2009, Grant of Higher Scale to Officers belonging to batches of Organized Group A Services that are senior by Two year or more and have not so far been promoted to that particular Grade. The Batches of IAS Officers and their corresponding grades are enclosed as annex in the DOPT letter. b) For the level of Director (PB-4 ,Grade Pay 8700): As per batch of MES officers as defined in DOPT letter Dated 21 May 2009 and further clarified by DOPT vide their letter Dt 11 Dec 2009. For Non Functional Up gradation only total length of the service as per IAS batch is the sole criteria in addition to ACR benchmarks required for the promotion. This is in view of the fact that the Grade Pay of Rs 8700 is the JAG NFSG of the Organized Gp A services other than technical services and for promotion to JAG NFSG Grade Pay in such services incl IAS from whom the pay parity is being drawn , there is no requirement of serving in JAG ( Grade Pay of Rs 7600) for a specified period. It is pertinent to note that The DOPT letter Dt 24 April 2009 is for Pay Parity/Non Functional Up gradation for all Organized Gp A Services incl tech and Non Tech Services. Also the DOPT letter Dt 15 Dec 2009 therefore mentions promotion criteria for SAG and HAG level only and not about the JAG (NFSG). c) For the level of SAG(PB-4 ,Grade Pay 10000): As per Para i) of DOPT letter Dt 15 Dec 2009 , Officers in the JAG ( Grade Pay Rs 7600) with 8 years regular in the Grade incl NFSG (JAG NFSG Gde Pay Rs 8700) OR Officers with 17 years regular service in Group ‘A’ posts in the service out of which at least 4 years regular service should be in the (JAG Gde Pay Rs 7600)( incl service rendered in the NFSG of the JAG”). d) For the level of HAG: Officers in the SAG ( Grade Pay Rs 10,000) with 3 years regular service in the Grade or Officers with 25 Years regular service in Gp A posts in the service out of which at least 1 year regular service should be in the SAG.
why we r relating min length of service with this non functional upgradation. I want to submit the following. 1. Pay commission while recommending the pay parity in para 3.3.12 & para 3.3.15 has not imposed any such condition. In fact the org group a services batch senior by two years from empaneled batch of IAS take care of all the eligibility criteria prescribed under central staffing scheme. The IAS r taking 20 years to get empaneled as joint secy whereas the CSS prescribed 17 years and IAS batches r getting physical promotion in 15-16 years in SAG scales in their respective states. 2. while accepting the above recommendations govt has added two more services viz IPS & IFS (to be given this non functional up gradation) besides org group a serices. In their case there is nothing like Revised Pay Rules and there was an immediate requirement of for amendments to their service rules in order to give the benefit of revision of pay under 6 cpc. If u see the amendments of their service rules for this non functional upgradation it is very simple & crips & reproduced below Note 3: Whenever any Indian Administrative Service officer of the State or Joint Cadre is posted at the Centre to a particular grade carrying a specific grade pay in pay band 3 or pay band 4, the members of Service, who are senior to such Indian Administrative Service officer by two years or more and have not so far been promoted to that particular grade, shall be appointed to the same grade on non -functional basis from the date of posting of the Indian Administrative Service officer in that particular grade.

Respected Madam, The 6th CPC unambiguously clarified the objective of Batch –wise parity with IAS officers in its report as • the gap in the pay between comparable batches of IAS and other Organised Group A services should be restricted to two years • to remove disparity among various Central Group A Services. • to bring a degree of uniformity in pay, promotional avenues and allowances amongst officers with same seniority.
This recommendation was accepted by Government of India vide resolution dt.29th August, 2008. Accordingly DOPT vide OM.No. AB.14017/64/2008-Estt.(RR) dt, the 24th April, 2009 had issued order to grant Non-Functional up gradation for Officers of Organised Group 'A' Services in PB-3 and PB-4. All the prescribed eligibility criteria and promotional norms including 'benchmark' for up-gradation to a particular grade pay would have to be met at the time of screening for grant of higher pay-scale under these orders. 6. Orders will be issued with the approval of the competent authority. Grant of higher pay scale on the non-functional basis would be from the date of posting of the first officer belonging to the particular batch of IAS officer at the centre. In case of any delay in the issue of orders, financial benefits under these orders will be given from the due date.

To correct this anomaly, we propose that the criteria for promotion from STS to JAG should be as follows:
STS to JAG: Officers who have completed 13 years of Group 'A' service in the service, calculated from the 1st Jan. of the year following the year of examination on the basis of which he or she was recruited , out of which at least 4 years of regular service should be in the STS Grade including the service rendered in non-functional Grade Pay of 7600.
We request you to kindly consider the above and issue an office memorandum accordingly.

ReplyDeleteThe EE ( NFSG) gd pay 7600 is the JAG Non Functional and gde pay 8700 is the JAG functional for engineers. As far as engineers are concerned the residency period at JAG shall start with gde pay 7600. The Director in Centre is with grade pay 8700. Thus to reach SAG grade the residency period of gde pay 7600 JAG shall be enough.The extract of V th pay commission as sent by SH N K Sharma is enclosed.

Pay scale for Superintending Engineers
50.45 We would, however, like to make an exception only in case of Superintending Engineers. It is a fact that the Second CPC had already established a parity between Superintending Engineers and Conservators of Forests by granting them both the scale of Rs 1300 – 1800. This parity was cemented further by the Third CPC which observed that “For the post of Conservator of Forests we recommend the scale which we have recommended for the Superintending Engineer grade of the Central Class I Engineering Service viz Rs 1800 – 2000.” For the Selection Grade of Conservator of Forest, the same commission stated that “a selection grade of Rs 2000 – 2250 should be introduced for the Conservator of Forests, on the same principle as recommended for the Selection grade in the Central Class I Engineering Service.” Between the Third and Fourth CPCs, there was an upgradation of the first grade for CFs to Rs 1800 – 2000. Subsequently, the Fourth CPC merged the scales of Rs 1800 – 2000 and the Selection Grade of Rs 2000 – 2250 and gave CFs the single functional scale of Rs 4500 – 5700. The same treatment in spirit was unfortunately not accorded to the SEs who were given a JAG of Rs 3700 – 5000 and NFSG of Rs 4500 – 5700. Taking into account the significant role of engineering services in the nation building process and the fact that the promotional prospects in the engineering cadre are rather bleak, We recommend that NFSG of RS 4500 – 5700 should be converted into a single functional scale for Superintending Engineers and the scale of Rs 3700 – 5000 should instead be the non-functional JAG for Exe. Engineers. However, in order to avoid too fast a rate of promotion in certain cadres to this grade, it is further recommended that promotions to the scale of Rs 4500 – 5700 would be permitted only on completion of 13 years of service in Group ‘A’. Although the above recommendation is being made in the context of CWPD engineers, it is clarified that this dispensation will be available to all Engineering Cadres in the Government.

It is thought to sort out the logjam on preparation of pay parity DPC list , following is the extract which can be sent to concerned officers officially or by indl officers to meet the iterpretation of other officers at E-in-C;s Br. The main issue is to delink pay parity with the functional eligiblity as mentioned in our RRS . My considerate opinion is that non functional and functional promotions can not be intermixed. The amdt to RR are required to show NF upgradation linked with the total length of the service. Kndly read the following as proposed to be sent to DPC .
ReplyDeleteThe amdt to RR is in progress based on DOPT letter no AB.14017/61/2008-Estt(RR)Pt Dated 15 Dec 2009. Since Amdt to RR is a time consuming process the non functional up gradation( Pay Parity) based on the DOPT letter dt 24 April 2009 as ref in MoD note ref in Para 1 shall be granted to all eligible officers.
4. Eligibility Condition for non Functional Up gradation as per various DOPT letters ref is appended below .
a) As per DOPT letter no. AB 14017/64/2008-Estt(RR) Dt 21May 2009, Grant of Higher Scale to Officers belonging to batches of Organized Group A Services that are senior by Two year or more and have not so far been promoted to that particular Grade. The Batches of IAS Officers and their corresponding grades are enclosed as annex in the DOPT letter.
b) For the level of Director (PB-4 ,Grade Pay 8700): As per batch of MES officers as defined in DOPT letter Dated 21 May 2009 and further clarified by DOPT vide their letter Dt 11 Dec 2009. For Non Functional Up gradation only total length of the service as per IAS batch is the sole criteria in addition to ACR benchmarks required for the promotion. This is in view of the fact that the Grade Pay of Rs 8700 is the JAG NFSG of the Organized Gp A services other than technical services and for promotion to JAG NFSG Grade Pay in such services incl IAS from whom the pay parity is being drawn , there is no requirement of serving in JAG ( Grade Pay of Rs 7600) for a specified period. It is pertinent to note that The DOPT letter Dt 24 April 2009 is for Pay Parity/Non Functional Up gradation for all Organized Gp A Services incl tech and Non Tech Services. Also the DOPT letter Dt 15 Dec 2009 therefore mentions promotion criteria for SAG and HAG level only and not about the JAG (NFSG).
c) For the level of SAG(PB-4 ,Grade Pay 10000):
As per Para i) of DOPT letter Dt 15 Dec 2009 , Officers in the JAG ( Grade Pay Rs 7600) with 8 years regular in the Grade incl NFSG (JAG NFSG Gde Pay Rs 8700) OR Officers with 17 years regular service in Group ‘A’ posts in the service out of which at least 4 years regular service should be in the (JAG Gde Pay Rs 7600)( incl service rendered in the NFSG of the JAG”).
d) For the level of HAG: Officers in the SAG ( Grade Pay Rs 10,000) with 3 years regular service in the Grade or Officers with 25 Years regular service in Gp A posts in the service out of which at least 1 year regular service should be in the SAG.
why we r relating min length of service with this non functional upgradation. I want to submit the following.
ReplyDelete1. Pay commission while recommending the pay parity in para 3.3.12 & para 3.3.15 has not imposed any such condition. In fact the org group a services batch senior by two years from empaneled batch of IAS take care of all the eligibility criteria prescribed under central staffing scheme. The IAS r taking 20 years to get empaneled as joint secy whereas the CSS prescribed 17 years and IAS batches r getting physical promotion in 15-16 years in SAG scales in their respective states.
2. while accepting the above recommendations govt has added two more services viz IPS & IFS (to be given this non functional up gradation) besides org group a serices. In their case there is nothing like Revised Pay Rules and there was an immediate requirement of for amendments to their service rules in order to give the benefit of revision of pay under 6 cpc. If u see the amendments of their service rules for this non functional upgradation it is very simple & crips & reproduced below
Note 3: Whenever any Indian Administrative Service officer of the State or
Joint Cadre is posted at the Centre to a particular grade carrying a specific
grade pay in pay band 3 or pay band 4, the members of Service, who are senior
to such Indian Administrative Service officer by two years or more and have not
so far been promoted to that particular grade, shall be appointed to the same
grade on non -functional basis from the date of posting of the Indian
Administrative Service officer in that particular grade.

Sub: Implementation of the Non-Functional Pay Parity for the Geology Stream of the Geological Survey of India, an Organized Group A Service, -Clarification thereof.

Respected Madam,
The 6th CPC unambiguously clarified the objective of Batch –wise parity with IAS officers in its report as
• the gap in the pay between comparable batches of IAS and other Organised Group A services should be restricted to two years
• to remove disparity among various Central Group A Services.
• to bring a degree of uniformity in pay, promotional avenues and allowances amongst officers with same seniority.
This recommendation was accepted by Government of India vide resolution dt.29th August, 2008. Accordingly DOPT vide OM.No. AB.14017/64/2008-Estt.(RR) dt, the 24th April, 2009 had issued order to grant Non-Functional up gradation for Officers of Organised Group 'A' Services in PB-3 and PB-4.
Important points are reproduced for your kind perusal.
(i) Whenever an Indian Administrative Services Officer of the State of Joint Cadre is posted at the Centre to a particular grade carrying a specific grade pay in Pay band 3 or Pay Band 4, the officers belong to batches of Organised Group A Services that are senior by two years or more and have not so far been promoted to that particular grade would be granted the same grade on nonfunctional basis from the date of posting of the Indian Administrative Service Officers in that particular grade at the Centre.
(ii) Grant of higher scale would be governed by the terms and conditions given in Annex-I.
Terms and Conditions for Grant of Higher Pay Scale on Non-Functional basis to Officers of Organised Gr.' A' Services.
3. All the prescribed eligibility criteria and promotional norms including 'benchmark' for up-gradation to a particular grade pay would have to be met at the time of screening for grant of higher pay-scale under these orders.
6. Orders will be issued with the approval of the competent authority. Grant of higher pay scale on the non-functional basis would be from the date of posting of the first officer belonging to the particular batch of IAS officer at the centre. In case of any delay in the issue of orders, financial benefits under these orders will be given from the due date.
